Terms of Service
The provider, and acceptance of these terms
The Cliqly service at cliqly.dev and all of its subdomains is operated by CLIQLY, a sole proprietorship with its registered address at Golf Island, Jl. Rukan Beach Boulevard No. 75 & 76, Jl. Concerto Beach Blvd, Kamal Muara, Jakarta Utara 14470 (referred to below as “we” or “us”).
By creating an account, accessing or using the Service in any way, you confirm that you have read and understood these Terms of Service and are bound by them, together with the Privacy Policy and the Refunds & Cancellation Policy, which form an inseparable part of this document.
If you do not agree with any of these terms, do not use the Service.
Cliqly is an independent business. We are not affiliated with, owned by or operated by anyone else. A third party using our API is a customer, not a partner or an owner.
Definitions
| Service | Everything Cliqly does: creating short links, managing domains, click analytics, QR codes, targeting rules, the REST API, webhooks and the dashboard. |
|---|---|
| User | An individual or a legal entity that creates an account and uses the Service. |
| Organisation | The container that owns domains, links and a subscription. One User may belong to several Organisations. |
| Link | A short URL created through the Service, made up of a domain and a slug, which redirects a visitor to a Destination URL. |
| Destination URL | The address a Link points at. Chosen entirely by the User. |
| Visitor | Anyone who opens a Link. A Visitor is not a User and has no account. |
| User Content | Destination URLs, slugs, titles, tags, QR images, uploaded logos and all other data you put into the Service. |
Accounts and User obligations
Eligibility
You must be at least 18 years old, or have valid consent from a parent or guardian, and have the legal capacity to enter into this agreement. If you sign up on behalf of a legal entity, you confirm you are authorised to bind it.
Registration details
The details you give when signing up must be true and complete, and kept up to date if they change. We may disable an account created with a false identity, someone else’s identity, or a disposable email address.
Account and API key security
- You are responsible for keeping your password and every one of your Organisation’s API keys confidential. A Cliqly API key grants full authority within its scopes without needing a password.
- All activity through your account or API keys is treated as your own, including activity by team members you invited.
- If you suspect your account or an API key has leaked, revoke the key from the dashboard immediately and tell us at support@cliqly.dev.
Email verification
Claiming a free subdomain on cliqly.dev requires a verified email address. Each Organisation is limited to three free subdomains, and each parent domain has a limit of its own. These limits exist to suppress bulk account creation used to spread fraud, and they are not something we compromise on.
Responsibility for User Content
You are entirely responsible for every Destination URL you shorten — its content, its legality, and how you distribute it. We do not review every Destination URL before a Link is created, and our not having acted on a Link does not mean we approve of it.
Prohibited use
A URL shortener is an easy target for abuse: a short link hides its real destination, and that is exactly what a fraudster wants. The rules in this section are therefore enforced strictly.
Fraud and social engineering
- Phishing: pages posing as a bank, a wallet, a courier, a marketplace, a government body, an email provider, or as Cliqly itself, in order to harvest credentials, one-time codes, PINs or card details.
- Investment fraud, Ponzi and pyramid schemes, fake lotteries and giveaways, fake prizes, job scams, “parcel held at customs” scams and loan scams.
- Pages imitating another party’s brand, logo or name so that a visitor mistakes who they are dealing with.
Malicious software
- Malware, ransomware, spyware, keyloggers, cryptojackers, and app installers (including APKs) distributed outside official app stores with intent to deceive.
- Pages that trigger automatic downloads, exploit browser vulnerabilities, or force an extension to be installed.
Unlawful content
- Child sexual exploitation material in any form. We act on this immediately, without warning, and report it to law enforcement.
- Content promoting terrorism, extreme violence, or hatred of a group on the basis of ethnicity, religion, race or class.
- Online gambling, narcotics and controlled substances, weapons, forged identity documents, stolen personal data, and hacked accounts or credentials.
- Infringement of another party’s copyright, trade marks or intellectual property, including distributing pirated works.
- Anything else prohibited by the law that applies to you or to us.
Abuse of the Service
- Spam: sending Links in bulk by SMS, messaging apps, email or any other channel to recipients who never consented.
- Shortener chains: using another service’s short link as a Destination URL. Such chains almost always exist to dodge scanning, and our systems refuse them.
- Using cloaking or targeting rules to show a different page to security scanners than to ordinary visitors. Those features exist for legitimate marketing needs, not to hide a destination from inspection.
- Doxxing, harassment, threats, or publishing another person’s personal data without a lawful basis.
- Creating multiple accounts to evade plan limits, rate limits, a suspension or a block.
- Load-testing, scanning or security-testing our infrastructure without written permission in advance; this includes load tests, excessive scraping and attempts to bypass API rate limits.
- Reselling the Service, or re-providing our API to a third party, without a written agreement from us.
Found abuse? Report it to abuse@cliqly.dev. Reports are answered every day, including outside working hours.
Enforcement: disabling Links, suspension and termination
A live scam link harms victims every minute it stays up, and that harm cannot be taken back. So the order is to act first and explain second, not the other way round.
Levels of action
- A warning page. For a Link that is suspicious but unconfirmed, the visitor sees a warning first and can choose to continue. The Link stays reachable.
- Disabling the Link. The Link answers
410 Goneand stops redirecting. Immediate, and reversible. - Suspending the Organisation. Every Link it owns answers
410 Gone, the dashboard becomes read-only, and every API endpoint that changes data answers403 org_suspended. Reversible. - Terminating the account. For serious or repeated breaches. The account is closed and the data permanently deleted after a 30 calendar day grace period.
Appeals
We can misjudge, and a legitimate business can be caught by a resemblance in pattern. You have the right to appeal in writing to abuse@cliqly.dev, including the affected Link URL and an explanation of what it is for. Appeals are reviewed by a person, not by an automated system, and we answer in writing within 5 working days. If the appeal succeeds, the Link or Organisation is restored at no cost.
No refund on suspension for a breach
Suspension or termination for a breach of section 4 creates no right to a refund for the remainder of the subscription period. The full terms are in the Refunds Policy.
Ending it yourself
You can stop using the Service at any time by cancelling the subscription and/or deleting the account from the dashboard. Deleting the account stops every one of your Links — make sure no printed QR code or distributed material still depends on them.
Subscriptions, billing and automatic renewal
Plans and prices
The Service is offered on the Free, Hobby, Pro, Team and Enterprise plans. The price that applies is the one shown on the pricing page at the time you subscribe, stated in US dollars. Sales tax or VAT due in your country is added at checkout by the payment processor acting as merchant of record.
The Free plan lasts indefinitely so long as the account is used in accordance with these Terms. It has no expiry date and never turns into a paid plan by itself.
Automatic renewal
A yearly subscription is charged for the equivalent of 10 months and gives 12 months of service. The next renewal date is always shown on the Billing page in the dashboard.
The payment processor
All payments are processed by Paddle on Paddle’s own checkout. Paddle acts as merchant of record, which means it sells to you, collects and remits any sales tax or VAT due in your country, and pays us net. Card numbers, CVVs and other payment credentials never pass through or rest in Cliqly’s systems; we store only the card brand, the last four digits and the expiry month and year, to show back to you. Your use of that checkout is also subject to Paddle’s own terms and privacy policy. Where an installation is configured to use Stripe instead, the same applies to Stripe, except that Stripe is not a merchant of record and tax obligations are handled separately.
Failed payments
If a charge fails, your access is not cut off on the first attempt — an expired card or a missed confirmation is ordinary and fixable. We show a notice in the dashboard, send one to your email, and the charge is retried several times on the payment provider’s schedule. If payment still fails after that sequence, the subscription ends and the Organisation drops to the Free plan.
Plan limits
Each plan has limits on Links, clicks per period, domains, seats and storage. When a limit is passed, existing Links keep serving traffic — we do not switch off a running campaign over a metering event. What is blocked is creating new Links or domains, with 402 quota_exceeded, until usage is back under the limit or you move up a plan. There are no automatic overage charges.
Moving up and down plans
Moving up takes effect immediately, and the difference for the remainder of the period is prorated by the payment provider. Moving down is possible only when your current usage fits inside the target plan’s limits; the dashboard names the figure that is blocking it. We never delete your data to make a downgrade go through. Switching between monthly and yearly billing starts a new billing period.
Invoices and tax
Invoices are issued by the payment provider and can be downloaded from the Billing page. If you need a tax identification number to appear on the invoice, enter it before paying. Any tax obligation arising on your side remains yours.
Price changes
We may change plan prices. A price change for a running subscription is never retroactive and never takes effect in the middle of a period you have already paid for.
- We tell you by email and by a notice in the dashboard at least 30 calendar days before a new price takes effect.
- The new price applies from the first renewal date after that notice period ends.
- If you do not accept the new price you may cancel before that renewal date at no extra cost. Continuing past the renewal date means you accept it.
A change in a tax rate or a government-mandated levy is not a price change within the meaning of this section, and applies from the date the relevant rule takes effect.
Cancellation and refunds
You can cancel at any time from the Billing page in the dashboard, without contacting us and without a cancellation fee.
Cancellation takes effect at the end of the period you have paid for, not immediately. Paid access — including every Link and domain already running — stays active until that date. After it, the Organisation drops to the Free plan.
Because access is not cut short, there is no refund for the remainder of the current period and no part-month refunds. We do refund billing errors, which can be raised within 14 calendar days of the invoice date.
The full terms — how to claim, processing time, and typical arrival times per payment method — are in the Refunds & Cancellation Policy, which forms an inseparable part of these Terms.
Service availability and support
We work to keep the Service available and fast, but the Service is provided as is and as available.
- We may carry out planned maintenance that causes brief interruptions, and we try to announce it in advance where we can.
- We may change, add or discontinue features. The discontinuation of a significant feature is announced at least 30 calendar days in advance.
- A risk specific to free subdomains. A free subdomain on cliqly.dev shares the parent domain’s reputation with every other user. In a large-scale abuse campaign we may suspend all free subdomains temporarily to protect that reputation, and third-party security vendors may block the parent domain entirely outside our control. For anything business-critical, use a domain you own.
- Support is by email to support@cliqly.dev with the response-time targets listed on the Contact page. A response-time target is not a resolution guarantee.
Intellectual property
All rights in the Service — the software, the interface, the Cliqly name, the logo and the documentation — belong to CLIQLY or its licensors. These Terms transfer no intellectual property rights to you.
User Content remains yours. You grant us a limited, non-exclusive, royalty-free licence to store, process, display and transmit User Content solely as far as is needed to provide the Service to you — storing a Destination URL so a Link can redirect, for example. The licence ends when the User Content is deleted, except for backup copies that expire on their normal cycle and aggregate data that can no longer be connected to you.
You may not reverse-engineer, decompile or copy any part of the Service, except so far as the law forbids that restriction.
Personal data
The processing of personal data is governed by the Privacy Policy, which sets out in detail what we collect from a click event, how long we keep it, and your rights under Indonesia’s Law No. 27 of 2022 on Personal Data Protection and, where applicable, the GDPR.
For data about visitors to your Links, you are the controller and we are the processor. You are responsible for ensuring that how you distribute your Links, and how you use the analytics they produce, complies with the law that applies to you — including any obligation to inform visitors.
Use of the API
The REST API is available on every paid plan. Its use is subject to everything in this document, plus:
- API keys are secret and must not be embedded in client-side applications, public repositories, or anything a third party can read.
- Rate limits apply and may be adjusted to keep the Service stable. A request over the limit is answered with an error code, not with an extra charge.
- We may change the API. A breaking change is announced at least 90 calendar days in advance, except where the change is required to close a security hole.
- The similarity of our request and response shapes to another shortener exists to make migration easier. It is a resemblance in shape, not a guarantee of full compatibility, and not a claim of affiliation with any service.
Limitation of liability
To the fullest extent permitted by applicable law:
- We are not liable for indirect or consequential loss, lost profits, lost revenue, lost business opportunity, lost data, or reputational damage arising from the use of, or inability to use, the Service.
- We are not liable for the content of a Destination URL, for the actions of third parties who open your Links, or for a Link being blocked by a security vendor, a telecoms operator or a third-party platform.
- Our total liability to you for all claims arising out of or connected with the Service is limited to the amount you actually paid us in the 6 (six) months before the event giving rise to the claim. For a Free-plan user who has never paid, that limit is nil.
The limits in this section do not apply to loss caused by our wilful misconduct or gross negligence, and do not set aside consumer rights that cannot be set aside under the law that applies to you.
Indemnity
You agree to indemnify and hold harmless CLIQLY, its officers and its employees against claims, proceedings, fines and reasonable costs (including legal fees) arising from your User Content, from how you distribute your Links, or from your breach of these Terms or of applicable law.
Force majeure
We are not in default for a delay or failure to perform caused by circumstances beyond our reasonable control, including natural disasters, fire, war, civil unrest, government action, widespread power or network outages, cyber attacks on third-party infrastructure, and the failure of an infrastructure or payment provider.
Governing law and dispute resolution
The parties will first attempt to resolve any dispute by discussion, within 30 (thirty) calendar days of one party giving the other written notice of it.
If that does not produce agreement, the parties agree to submit the dispute to the District Court with jurisdiction over the registered address of CLIQLY, without prejudice to a consumer’s right to use any consumer dispute-resolution mechanism the law provides.
Changes to these Terms
We may change these Terms — because features change, because a payment provider changes, or because the law changes.
- The current version is always on this page, with a “Last updated” date at the top.
- Material changes — to the limits of liability, the cancellation terms, or your rights over your data — are announced by email and by a dashboard notice at least 30 calendar days before they take effect.
- Non-material changes, such as corrections to grammar or added explanation, take effect on publication.
- Continuing to use the Service after a change takes effect means you accept the new version. If you do not accept it, cancel before the effective date.
If any provision of this document is held invalid or unenforceable, the rest remains in full effect.
